SELL OR CONSIGN YOUR FIREARM — TERMS & CONDITIONS

Please read these terms before submitting a firearm. Submitting the form above confirms that you have read, understood, and agree to them.

1. General

• Submitting the form is a request only and does not create a binding agreement. All offers, prices, and acceptance are determined by Kinetic Armory at its sole discretion following inspection.
• You certify that you are the lawful owner of the firearm, that it is free of liens, claims, or encumbrances, and that you are legally eligible to sell or transfer it under all applicable federal, state, and local law.
• You certify that the firearm is not stolen, has not been reported lost or stolen, and has no obliterated, altered, or missing serial number.
• All transactions are subject to federal, state, and local law, including background checks, required documentation, and all applicable transfer requirements. Kinetic Armory may decline any firearm for any lawful reason.
• You must be 21 years of age or older to sell or consign a firearm with Kinetic Armory.

2. Inspection & Intake

• Any quote provided before inspection is a preliminary estimate only and is not a guaranteed offer. Final value is determined only after Kinetic Armory physically receives and inspects the firearm.
• Kinetic Armory must have the firearm physically in hand before any offer is finalized, any listing is created, or any payment or credit is issued.
• You are responsible for delivering or shipping the firearm to Kinetic Armory. Inbound shipping, insurance, and any associated transfer costs are your responsibility unless otherwise agreed in writing.
• Firearms shipped to us must be sent in compliance with all carrier and legal requirements and routed through a valid FFL where required.
• Condition, functionality, completeness, and value are determined solely by Kinetic Armory upon inspection. If the firearm differs from how it was described at submission, Kinetic Armory may revise or withdraw any offer.

3. Selling Your Firearm to Us (Outright Purchase)

• If you accept our offer, the firearm becomes the property of Kinetic Armory upon completion of the transaction and all required transfer documentation.
• Offers are valid for the period stated at the time they are made. If you do not accept within that period, the offer expires and may be revised.
• Payment is issued in the form agreed at the time of acceptance after all transfer and documentation requirements are complete. Once an outright sale is completed, it is final.
• Kinetic Armory’s purchase offer reflects resale value and is not retail price; the offer accounts for handling, processing, and the costs of reselling the firearm.

4. Consigning Your Firearm

• Fee. The standard consignment fee is 20% of the final sale price. Eligible members consign at a reduced rate as described in our Membership Program. The fee covers professional photography, listing creation, marketing, and standard processing.
• Minimum value. Firearms must have a consignment sale value of at least $1,000 to be accepted into the consignment program.
• Photography & listings. Kinetic Armory creates all listings and handles all product photography. Listing placement, descriptions, and presentation are at our discretion.
• Pricing. The listing price is agreed at intake. Kinetic Armory makes no guarantee as to whether, when, or at what final price a firearm will sell, and may recommend price adjustments over the consignment period.
• Ownership. Consigned firearms remain the property of the consignor until sold. NFA Form 4 transfers directly from the consignor to the buyer upon completed sale.
• Term. The standard consignment term is 90 days from intake. If the firearm has not sold by the end of the term, you may renew it for an additional period or arrange retrieval.
• Retrieval. A firearm reclaimed by the consignor is returned through a valid FFL. Any transfer and return-shipping costs are the consignor’s responsibility.
• Unclaimed firearms. If a consignment term ends and the consignor does not renew, retrieve, or respond to Kinetic Armory’s notice within 30 days, the firearm may be deemed abandoned, and Kinetic Armory may sell it to recover storage and handling costs, applying any proceeds beyond those costs to the consignor’s account, to the extent permitted by applicable law.
• Payout. Proceeds, less the consignment fee and any disclosed costs, are paid to the consignor after the sale is complete — meaning the buyer has paid in full, the transfer is finished, and any buyer inspection period has passed. Sales are final once the buyer’s inspection period closes.
• Care while in our possession. Kinetic Armory stores and secures consigned firearms with the same care given to its own inventory and is responsible for loss or damage occurring through its negligence while the firearm is in its possession, up to the agreed consignment value. Kinetic Armory is not responsible for normal handling, ordinary wear from display and demonstration, or loss outside its reasonable control.

5. Items We Cannot Accept

• Firearms that are stolen, illegally modified, or have an altered, defaced, or missing serial number.
• Firearms that are non-functional, unsafe, or that cannot be lawfully transferred.
• NFA items, machine guns, or other restricted items except where specifically arranged in advance and handled under all applicable law.
• Any firearm where lawful ownership or eligibility to transfer cannot be established.

6. Additional Terms

• You agree to indemnify and hold Kinetic Armory harmless from any claim arising out of a misrepresentation of ownership, condition, or legal status of a submitted firearm.
• Kinetic Armory reserves the right to modify, suspend, or discontinue its sell and consignment programs, or any term, fee, or rate, at any time. Submissions in progress will be handled under the terms in effect at the time of intake.
• These terms are governed by the laws of the State of Oklahoma. This summary describes our sell and consignment programs and is not a substitute for the intake agreement you will sign; in the event of any conflict, the signed intake agreement governs.
